Tirol Adventures - Terms and Conditions

1. Tirol Adventures as a brand of DS business GmbH (here called TA) presents the adventure offer in Tyrol clearly and meets thereby a preselection for its customers. The criteria are: safety, quality, service and, of course, fun. TA is a facilitator of recreational activities, but does not perform on its own. Organizers are different partners of the TA (also called service partners), who perform the service for their own account and are solely responsible for the performance of the adventure / experiences. The terms and conditions of the service partners apply to the implementation. 
2. A contract between TA and the customer is only concluded via the agency service, the following terms and conditions apply in the version valid at the time of the order. The contract regarding the booking and execution of the respective adventure is concluded directly between the customer and the respective organizer. The fulfillment of the booked service is therefore not part of the performance obligation of TA. .

1. The customer buys either a coupon for a certain type of adventure (adventure voucher) or a general voucher (PrePaid voucher) issued on the amount. The coupons must be activated online for a specific adventure / experience so that the coupon can be redeemed at the partner. After activation, the customer and the service partner receive the contact data from each other and can set an appointment for the adventure. The voucher is to be handed in to the organizer. .
2.  Adventure coupons can be exchanged for a PrePaid coupon. Thus, it is possible to opt for another adventure until the activation. .
3. If the value of the chosen adventure is higher than the amount of the PrePaid coupon, the difference is to be paid. Conversely, if the value of the chosen adventure is less than the amount of the PrePaid voucher, the remaining credit will be retained on the voucher. The remaining balance can be requested online with the voucher number. 
4.  The voucher can be redeemed within 3 years of the date of issue. After this period, a one-time extension of the voucher for a further year against a processing fee of € 20.00 is possible. 
5.  The voucher is freely transferable, but care must be taken that the person complies with the eligibility requirements of the adventure. 
6.  Some adventure / experiences are dependent on a minimum number of participants, below which the experience does not take place. The vouchers will remain valid in this case and a new date will be announced. 
7.  The vouchers can not be redeemed in cash. 

1. All prices quoted are final prices and include the statutory value added tax. In addition to the named prices may be incurred costs for packaging and shipping, but these are shown separately. 
2.  The TA price guarantee is based on the normal retail price of the service partners. Actions or discounts for certain groups of people are excluded from the price guarantee.

1.  Discount codes can not be combined with other discount promotions. Only one discount code can be redeemed per order. Discount codes have a limited validity and a minimum order value. For pre-paid vouchers created by the exchange of adventure vouchers, the subsequent deduction of discount codes is not possible. It is not possible to be credited when exchanging for a PrePaid voucher. A cash payment as well as a subsequent crediting on already placed orders is excluded.

1.  Payment arrangements The ordered vouchers can be paid by invoice (bank transfer), credit card or cash on delivery. If paying by invoice, the amount must be paid within one week of receipt of the bill, the vouchers will be released in this variant only after full receipt of payment at TA for activation. When paying by credit card, the voucher can be activated immediately. 

1. The gift voucher is delivered within 3-7 working days to the address given in the order. Of course, the PDF version for Last Minute gifter is available free of charge after a few minutes.

1.  Withdrawal Consumers have the right to revoke their order in writing (letter, e-mail) within 14 days of receipt of the voucher without giving reasons or by returning the original voucher with full and unused content. 

1.  Participation in certain experiences requires a minimum of personal aptitude (e.g., height, age, health, weight). These requirements are named in the individual adventure descriptions. After activation, the purchaser of a voucher is responsible for ensuring that the appropriate person to participate in the particular experience meets the minimum requirements. A refund of the purchase price is excluded in case of non-fulfillment of the minimum requirements. 

1.  A right of withdrawal exists even if the experience can not be carried out due to force majeure, especially due to bad weather conditions. The decision as to whether bad weather prevails, leading to the cancellation of the event, is the sole responsibility of the organizer. Participants are obliged to consult with the organizer in good time, whereby the last possible time and the necessary contact information are listed in the booking confirmation. In case of cancellation by the organizer, the participant has the right to make a free rebooking. Compensation for any arrival or accommodation costs will not be paid. 

1.  Until the advent of an experience by the voucher holder, TA is entitled to rescind the contract for good cause. An important reason is, for example: .:

•  the organizer is no longer a performance partner of TA or has generally ceased his trade
•  the event organizer is not economically reasonable to carry out the event. 
•  Force majeure 

1.  TA reserves the right to make changes in the organizer or the adventure. In the event of a material change in the content of an adventure, the customer is entitled to withdraw from the contract free of charge or to choose an equivalent adventure from the TA offer.

1.  Information about mediated adventures / experiences are based solely on the information provided by the organizer and are not an assurance of TA to the customer. 
2.  TA is not liable for the provision of the brokered adventures / experiences by the organizer, but only for the careful selection of the respective organizer, the proper communication of the experience and the proper and demonstrable transmission of information, advertisements, declarations of intent and payments between the customer and the organizer. 
3.  TA is liable without limitation for damages resulting from the breach of contractual obligations up to the amount of the mediated event price. For further damages TA is only liable for intent or gross negligence..
4.  TA assumes no liability for the unlawful redemption of vouchers. In the event of the loss or theft of vouchers or tickets, the customer is obliged to immediately contact TA in order to arrange for the code to be blocked.

1.  Until full payment, the coupon remains the property of TA. Payment must be made no later than one week after the date of invoice (invoice date). At the end of this term of payment TA has the right to withdraw from the contract at any time or to cancel the voucher, resulting bookings or credits. The legal claims regarding the consequences of the delay in payment remain unaffected. The redemption of the voucher is only under the condition that the purchase price for the voucher has been fully served to TA.

1.  The invalidity of individual provisions of the agency contract or the terms and conditions does not invalidate the entire contract. 
2.  The competent court in Innsbruck shall be the place of jurisdiction for all legal disputes arising from a contract with business customers. 
3.  All images and text may be used only with the consent of TA.
